More on a musician in a very fruity situation

Here is a little more on the Fiona Apple situation. This article has little more info and all sorts of links. Now I know I'm kinda harping on this, but this is just such a blatant display of what is wrong with the music industry, that I can't help it.Also this shows why the copyright laws need work, these laws no longer protect the artists or are in the best interest of the public. I'm not trying to tell you that p2p should be legal or that I should be able to freeload off of artists. Actually I am saying quite the opposite, these laws need to be changed to protect the artists. Although I do believe that p2p and artists can, not only work together, but profit from each other. I believe that the well being of our artists, technology, and the general public, are all very closely knit together.

BAH I didn't mean to write this long tonight. Well in any case here is one more story. A story of a rather intelligent young man(although his owning an Ipod would suggest otherwise), a letter he wrote, and the schemings of a (hopefully) dieing cartel.

Getting rich off the backs of the poor?? hard working actors and pop stars. Thats debatable, now the music industry on the other hand, yes yes they are. the music industry gets rich off the backs of these people and the bands have to tour to make money. Oh wait thats if their contracts allow them to, after all Fiona Apple has had a new album out for years now and been unable to make a cent off of it. Why?? not because it's bad music(if that were the case 99.9% of all artist would be beggars, quite to the contrary its supposed to be amazing), and not because people won't pay for her album. The reason shes been denied a new sources of income is because the short sighted bigbosses of the music industry like keeping their heads up each others asses, and would rather push their CRAP down our throat instead of releasing her album. Because of this she can not tour or make money from her music.Now to those of you saying that they don't HAVE to tour, no your right they could just get by off of the 5-10% royalties they get. OH wait thats if they get paid.

Bah and as to the legality of p2p, common with that excuse you could say the same of IRC, never the less it still used legitimately. Wait tho as one of the best ways for independent artists to spread their music, just think what sort of threat banning p2ps would eliminate for the music industry. really common now privately owned guns are commonly used to rob banks and kill innocent people so lets ban that too huh?? for the love of god!!!

Why my dear sweat daughters mother won't marry me

welll I just had an interesting realization tonight. I just realized its
easier for me to lie then tell the truth. Now that doesn't mean I'm a chronic lier or that I would rather lie then tall the truth, it just means this. If you ask me what I did today 1 of 4 things will happen. 1) I will tell you the very little, get frustrated for no apparent reason, and be like, "nothing GOSH". 2)I'll just shrug it off, say nothing, or say "not much". 3)I had a great day I won't shut up or, 4)Ill spin a whole story for you with all sorts of details happenings.

I don't know why but building half truths and stories come more
naturally and are probably closer what actually happens in general, then actually telling the truth. bah go figure, any ways this blog by email seems to like me except for the weird formating problems (I mean the weird carriage returns you saw in the last post) so this is how ill be posting from now on. I'm thinking of reviving my paper routes. I mean Ive been staying up all night till the papers would be dropped off to my house anyways so I might just flip my schedule. We will see, it depends on if there are any routes open in my neighborhood. night all I go on to bigger and better things.

A whole new level of lasyness

From now on, depending on how this ends up looking, I think I will be posting from my mailbox. This way I can type stuff offline and not be bothered with logging on to the site which is a [chose your own expletive] with dial-up. Sooo now I have next to no reason not to post more frequently, so we will see.

Today I took my 3rd test for the navy. This one was to see if I could make it into better jobs, it was sooooo easy. now that isn't to say I did well, I actually had quite a bit of trouble with it, but thats what I get for taking it with a unexercised brain. I am at the moment very envious of kal el, I'll let him gloat about that tho.

Ahh one more thing I just rediscovered the fact that you can manually edit the templates for blogspot.com, so maybe in the near future you will see some changes to the site. Hopefully yaa?? Actually when I said one at the beginning of the paragraph, I meant three that are connected. With the rediscovery of the template editing I decided to put an XML feed link on my site. Thats right folks, the demand for me is sooo great that I syndicated myself. Don't expect the link to stay where it is, I don't like the look, but until I can sit down for ten minutes at a time, and decipher the template code, thats the best I can do. Lastly I found out that blog spot has ftp support hopefully ill get a chance to play with that some more.

Like money out the A**

Only more pain and fewer paper cuts...... ohhh wait a minute, that shed's a whole new light on why McGreevy raised the McGreevy for dropping a improper left turn(3 points) to a dangerous driving (0). GAHHHHHHHH I swear I hope that man dies soon so I can dance on his grave(even if kal pisses on it first(ohh ill bring my cat::evil grin::)). Ok I guess I better explain.

a simple left turn off of 206 has cost me $400. Lemme go back a little, I was driving around one night with kal el one rainy night. Hell I don't even remember where we were going, but I missed an exit and had to take the next one, can you guess witch one?? Yep 206. Anyways I get off onto 206 and then make a left at the next light, and one more left after that. When I make this turn, I cant see the road because there are street lights right at the intersection but none past, oh and no traffic. So I make the turn and end up in the wrong lane of traffic, which i promptly correct. Half a mile down the road I look in my mirror and see flashing lights coming up behind me. So to make a long story short, the cop pulls me over and tries to get me to admit to speeding, then proceeds to look over every part of my car for something to give me a ticket for(he does this casually outside only but he was REALLY looking and asking questions). In the end he gives me a ticket for an improper left turn for what I assumed was the second turn.

Well it turns out it was the first left which he was ticketing me for not the second. The turn off of 206 has a jughandle for all turns that I missed in the poor visibility. I mean I'm never down that road, never the less I accept the that I broke the law I'm fine with paying for that. What really gets my goat tho is that the cop knew that I didn't't't know I mean it was pretty obvious we were talking about two different things but he just gave me the ticket he did care he'd of loved to see me do what I did twice. This cop wasn't't't't there to uphold the law, he was there to make a quota, as he proved by pestering me on every perceived problem with my car. Also this happened around 10:00pm no traffic and no reason we shouldn't of been out(like if it had been 1am). I love to watch when some prick hops in the wrong lane because its faster and gets busted by the cops. Hell if you ever see me do that please run me off the road, But the roads WERE EMPTY, please cut me a little slack??

Now add on top of that that it costs $400 dollars to make it a pointless ticket!!! I mean common speeding or careless driving, fine i can see that but improper left turn, at what looked like a normal 2 lane intersection(1 lane one way one the other that is)!!!! You know what the hell was McGreevy thinking. any ways thats my life right now. I should sleep i have landscaping tomorrow and I need all the rest i can get for that, or i might blow up in a fiery ball of pure anger. Landscaping does that to me like 600,000lbs of jet fuel does to fire(btw thats roughly 100,000gal, so you could hear me screaming clear across the state I think).

PS if your wondering how far away you should be when and if I go off. don't worry, I'm a screamer, and after so much anger leaving me so quickly with that scream I'd probably implode with enough force to send me into another dimension. Last time I lost it I ended up here which was bad enough, so I think I'll try to avoid doing that again.

PSS This post really should go on so that one may speak but i didn't relize this till now and im tired and lasy and this reflects my state of mind so DEAL. I know i can and will:P

The criminals aren't the people who have had enough of being ripped off by the cartel. Nor are the p2p networks and application operators (they could have, and should have, been used by the labels to enter the digital 21st century) the means by which crimes are being committed.

The true criminals are the highly skilled international organized crime gangs who routinely dance rings around the record label and move studio cartel executives who run the MPAA (Motion Picture Association of America), RIAA (Recording Industry Association of America), IFPI (International Federation of the Phonographic Industry's), BPI (British Phonographic Industry), and so on.

Gundersen says, "Unlike iTunes or Napster, enthusiast sites place community above commerce, earning credibility and loyalty that are crucial to luring youth dollars. That's one of the sticky challenges facing an industry that alienated downloaders with steep CD prices and piracy lawsuits."

Music industry spin doctors use the 'settlements' as PR fodder. They tell the media they've successfully 'sued' thousands of people for breaking the law: for sharing files, in the process depriving them of their rightful earnings.

That these people have 'settled' is used to suggest that by doing so, they've admitted guilt of some kind.

However, none of this is true, or even nearly true.

And no one has been sued.

What's happened is: approaching 10,000 people have received frightening subpoenas, documents most of them had never heard of before, let alone actually seen. But not one of the subpoena recipients has ever appeared in a court, and fewer than 2,000 'cases' have actually been 'settled'.

An average $3,000 settlement multiplied 2,000 times comes to what? And the labels have never said where the money goes. But you can bet it doesn't reach the hands of the hard-pressed workers the industry holds up as victims of file sharing.

Most of those who agreed to buy the RIAA off did so only because they literally had no other alternative.

They simply didn't, and don’t, have the financial or legal resources to take on the multi-billion-dollar industry with its bottomless pockets, teams of lawyers and obscene political influence.

It’s as if the labels have taken the famous line from Francis Ford Coppola’s The Godfather where Brando says chillingly, "I'll make him an offer he don't refuse."

Well, the RIAA makes its victims offers they don’t refuse – Pay us. Or else.

As RIAA spokesman Jonathon Lamy admits in the Village Voice, so far, "none have come to trial”.

And none will unless, by some awful mistake, the RIAA tries to nail someone important; someone with money and legal and political clout who can take them on in a fair and equal court trial.


Not guilty
In the meanwhile, no one has ever been found guilty of the crime of ‘file sharing,’ all the mainstream media reports to the contrary notwithstanding.

The time-honoured, almost sacred, principal of Innocent until proven Guilty is mocked by the entertainment industry which, with the active and enthusiastic assistance of the mainstream media, regularly and routinely holds people of all ages up as criminals who have been tried and convicted of the heinous crime of sharing with each other online.

And while all of this happens the true criminals – the counterfeiters and duplicators who use the readily and universally available physical software, music and movie CDs and DVDs as masters with which they make and sell their own ‘product’ underground – count their profits, virtually unscathed.

I swear geek articles are becoming my reason to post. Anyways this is not that interesting an article actually, most people probably know most of what it says, I'm just giving you the footnotes early. what was interesting tho was that second to last paragraph, the quote. Its a really good point I never thought of it that way. I mean I would NEVER buy DCMAed music, I'm sorry not gonna happen. While i always thought is was cool that schools were covering your music cost, I never realised I was still paying for it, just through my tuition. Why the hell am I gonna pay more(albeit a VERY tiny amount more) for a service I DO NOT support and I actually believe to in my best interests not to support. I think that the students should be given a choice. Hell I'll pay for my music IF, its in a non DRM format. I mean If I like the music I'm gonna support the artist.

That being said I still think that $.99 is an outrageous amount to pay for any music not given to me in a physical format. Albums average ohh 12 songs a CD, you can buy a CD for $11-$15 if you shop around. About the same cost as downloading the songs. but look at the costs. With CDs you have the cost of the disks, the cost of the hardware to burn them, and the maintenance of that hardware. Not to mention when I buy these, as a customer I get the added benefits of cover art,lyrics, and all the production info. Also a plus is that I can make a perfect copy of the original and stick the original some place where it will be safe baring catastrophes. Digital music(yes I know CDA is digital but I mean music you are not given a psychical copy of) has next to no production costs(I mean its just a matter of encoding the music), millions of copies can be spawned at the cost of bandwidth, and several layers of middlemen can be cut from distribution costs. From the end-user side, its hard to store the data safely, on any form of rewritable media data corruption is possible and even common and CD-Rs are not as reliable as professional CDs. There is also no information about the music that comes with it, except what is in (if there is any) the ID3 tag(or equivalent), and that is minimal at best. Now add DRM and it is illegal to make perfect backups(or any backup for that matter) of your music. How long till you misplace a music file, or you hard drive crashes, or you drop your DRM approved device in the mud while getting out of the car without noticing and leave it to freeze there over night???(not that hard trust me I've done it with my cell). Considering all of this why do CDs and downloaded music cost about the same???

People suck

My gosh, comparing software to a high security building!!! I'd like to see some one replace or fix a building in under a week. Actualy the artical is not my problem. I agree that having software flaws passed on to those who would exploit it to the harm of others is not good. Never the less this will happen any ways, whether you play ostrich or not. Now on the other hand, if you pass a law that says that companies are the only ones to be notified of flaws, you may get the companies playing the ostrich. In high security buildings there are the builders, and the people whose job it is to respond to security issues. Thats two seperate groups, the latters job is to fix any problems with the formers its a check and balance of sorts. On the other had in security software the builder does both, and is therefore more likely to hide flaws. I think that it is much wiser to let those who want to know, know exactly what problems of the software they are using/buying are, and how quickly they are fixed. As I have said before almost all software sucks. I would be more suspicious of security software that seem to be and always have been perfect, then one that has had known flaws that were quickly atended to. To me what would be much more covincing to me is a full list of past problems and how the company reacted to them. As far as im concerned I would want the company I use to, encourage people to find flaws and to publish them, and to alert its users to these errors and tell them what precations to take until the holes were fixed.

well I had a great taichi class to tonight and I've been now 21 for a whole day almost two. Umm thats about it, ohh I saw Amelie last night for the first time and The jacket last night, both of which are great movies. night all sleep well.

{The most vile thing you can think of}

Microsoft Does it again! Taking over an amazing company to do lord knows what with. This time the victim is Giant Company. Now I'm no Microsoft hater. Yes I believe they are the kings of mediocrity, and yes there software is BAD, but you know what, there is very little perfect software out there and NO perfect OSes out there. In any case I will give Microsoft is props where it deserves them, IE NOT ON THEIR SOFTWARE!!

Microsoft amazingly enough has under stood its need for better security in its OS, or rather the possibilities in the anti-spyware(AS) market, so what does it do?? Does it assign some of its own people to make and/or ask the AS community for help making some software?? NO! Instead it takes one of the best, although little know, AS company it can find and buys it out!!! This suggests that MS has no intention of giving back the the AS community and even worse may kill what was once one of the best pieces of AS software out there.

I suppose I should explain a little about Giant Company. Giant is one of those many Internet annoyances companies out there. They make Anti-spam/pop/spyware software. Interesting thing about AS programs is that, unlike firewalls and antivirus which were first marketed to companies and privet users latter, AS started as software for the every day user. Giant was looking like one of the first Professional level AS out there, they really had a very large database. Now I fear that With MS the DB will become outdated. I am also afraid of what MS will do to the software itself. MS is know for its bloated interfaces and security holes, and hell you know that because this program is made by MS, It will be targeted by every piece of malicious code out there. Great now the best AS software out there is a major target. Might as well of gone to cracker bb and/or chatroom been like bet you can't utterly decimate this software. Lastly I DO NOT TRUST MICROSOFT!!!!!!! Please MS stay a way from security leave it to people with morals(or vested interest in keeping your trust in its security) and coding skills.

Any ways life is good, tho i am jobless and feeling the squeeze. I am also sleeping days now and working nights till say ohh 5 am. Its a good life:).
